The presentation will open with a brief overview/history of eminent domain cases in the United States and the bedrock Fifth Amendment right of no taking without just compensation. We’ll then turn to expropriation in Louisiana: under what circumstances can the government take private property and what is the procedure? Then, what can a landowner do to contest such a taking. Operating a motor vehicle after consuming alcohol or other impairing substances remains a significant cause of vehicle crashes, serious injuries, and fatalities in Louisiana. In 2021, more than 40% of the motor vehicle crashes in Louisiana were alcohol-related. The number of alcohol-impaired driving fatalities was 299. The good news is that only about 1/3 of those convicted of Operating a Motor Vehicle while Intoxicated become repeat offenders. How do we identify who is most likely to be in the two-thirds of first offenders who present the most significant risk of committing a subsequent offense? What can we do to reduce that risk? Come to this session to learn how to answer those questions.
